Mat\u00e9ria modifica o Estatuto do Desarmamento<\/strong><\/em><\/p>\n\n\n\n

A Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a (CCJ) do Senado aprovou, nesta quarta-feira (16), em Bras\u00edlia, projeto de lei que autoriza o porte de armas de fogo para agentes de seguran\u00e7a socioeducativos \u2013 que lidam com jovens infratores \u2013 e tamb\u00e9m para oficiais de justi\u00e7a.<\/p>\n\n\n\n

Como a mat\u00e9ria foi aprovada em car\u00e1ter terminativo, se n\u00e3o for apresentado recurso para vota\u00e7\u00e3o no Plen\u00e1rio do Senado, o texto seguir\u00e1 direto para an\u00e1lise da C\u00e2mara dos Deputados. O projeto de lei 4.256 de 2019 \u00e9 de autoria do senador Fabiano Contarato (PT-ES).<\/p>\n\n\n\n

\u201cA realidade \u00e9 que esses agentes socioeducativos fazem um trabalho de fundamental import\u00e2ncia, colocando em risco a sua vida, a sua integridade f\u00edsica, a sua integridade moral e a de sua fam\u00edlia e a pr\u00f3pria sociedade. Se houver uma invas\u00e3o dentro de uma unidade de interna\u00e7\u00e3o para adolescentes em conflito com a lei, as pessoas que ser\u00e3o atingidas ser\u00e3o esses agentes socioeducativos\u201d, argumentou o parlamentar.<\/p>\n\n\n\n

O projeto modifica o Estatuto do Desarmamento (Lei 10.826 de 2003), que regula a posse, o porte e a comercializa\u00e7\u00e3o de armas de fogo no Brasil. O relator da mat\u00e9ria, senador Esperidi\u00e3o Amim (PP-SC), acatou emendas que inclu\u00edram tamb\u00e9m os oficiais de justi\u00e7a como categoria com direito a porte de arma de fogo.<\/p>\n\n\n\n

Prote\u00e7\u00e3o para a categoria<\/strong><\/h2>\n\n\n\n

A medida foi tomada \u201cdiante da necessidade de assegurar a prote\u00e7\u00e3o da categoria [oficial de justi\u00e7a] em face dos riscos inerentes \u00e0s suas fun\u00e7\u00f5es, como cumprir ordens judiciais em situa\u00e7\u00f5es potencialmente violentas, sem a presen\u00e7a constante de seguran\u00e7a policial\u201d, justificou o senador Hamilton Mour\u00e3o (Republicanos-RS), que leu o parecer do senador Amim durante a sess\u00e3o.<\/p>\n\n\n\n

O projeto de lei prev\u00ea isen\u00e7\u00e3o de taxas de registro e manuten\u00e7\u00e3o de armas por parte dos servidores, sejam adquiridas de forma particular ou pela institui\u00e7\u00e3o a que estiverem vinculados.<\/p>\n\n\n\n

\u201cMuitos desses servidores j\u00e1 enfrentam press\u00f5es econ\u00f4micas e a necessidade de pagar por esses procedimentos poderia inviabilizar o exerc\u00edcio do direito concedido pela lei\u201d, justificou o relator Amim.<\/p>\n\n\n\n

Porte de arma<\/strong><\/h2>\n\n\n\n

Pelo texto, os agentes respons\u00e1veis pela seguran\u00e7a, cust\u00f3dia ou escolta de adolescentes ter\u00e3o direito ao porte, tanto em servi\u00e7o, quanto fora dele.<\/p>\n\n\n\n

A proposta obriga os agentes a comprovarem capacidade t\u00e9cnica e aptid\u00e3o psicol\u00f3gica para o manuseio da arma de fogo e permite a compra e posse de arma por agentes menores de 25 anos, o que hoje n\u00e3o \u00e9 permitido ao cidad\u00e3o comum.<\/p>\n\n\n\n

A proposta ainda pro\u00edbe o uso ostensivo da arma. Ou seja, elas dever\u00e3o ser escondidas no corpo. O porte de arma permite que a pessoa transite com o armamento. \u00c9 uma autoriza\u00e7\u00e3o mais ampla do que a posse de arma, que permite apenas usar o armamento no interior da resid\u00eancia ou local de trabalho.<\/p>\n\n\n\n
